1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of Krixa AI ("Krixa", "we", "us", or "our"), an AI-powered SaaS platform operated from the United Kingdom and accessible at https://krixa.ai. By creating an account, accessing, or using the service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use Krixa AI.
2. Description of Service
Krixa AI provides AI-powered content generation tools for marketing and social media, including but not limited to: Instagram Carousels, Instagram Captions, Facebook Posts, LinkedIn Posts, X Threads, WhatsApp Promotions, and Email Campaigns. The service is provided on a software-as-a-service basis and may be updated or modified from time to time.
3. User Accounts
You must be at least 16 years of age to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@krixa.ai if you suspect any unauthorised access to your account.
4. Free Trial
We may offer a free trial period for new users. Free trials are limited to one per individual or organisation unless otherwise specified. Trial accounts are subject to usage limits and may not include all features available to paid subscribers. At the end of the trial period, you must subscribe to a paid plan to continue using the service.
5. Subscriptions and Billing
Paid subscriptions are billed in advance on a recurring basis through Stripe, a third-party payment processor. By providing your payment information, you authorise us to charge the applicable subscription fees to your designated payment method. All fees are exclusive of taxes, which are your responsibility where applicable. Subscription fees are non-refundable except as expressly set out in these Terms.
6. Cancellations
You may cancel your subscription at any time through your account settings or the Stripe billing portal. Cancellation takes effect at the end of the current billing period, and you will continue to have access to the service until that date. We do not offer prorated refunds for partial billing periods.
7. Refund Policy
Krixa AI is a subscription-based digital service. Subscription payments are generally non-refundable once access has been provided. Users can cancel their subscription at any time to prevent future billing. If a billing issue occurs, users can contact hello@krixa.ai and we will review the request fairly.
8. User Responsibilities
You are solely responsible for the content you input into Krixa AI and for the outputs you generate, publish, or distribute using the service. You must ensure that your use of the service complies with all applicable laws, regulations, and third-party platform terms. You are responsible for reviewing all AI-generated content for accuracy, appropriateness, and compliance before publishing.
9. Acceptable Use
You agree not to use Krixa AI to generate, distribute, or promote content that is unlawful, abusive, harassing, defamatory, obscene, fraudulent, deceptive, infringing upon intellectual property rights, or otherwise objectionable. You must not use the service to create spam, malware, or content that violates the terms of service of any third-party platform. You must not attempt to reverse engineer, decompile, or extract the source code of the service, nor use the service to build a competing product. We reserve the right to suspend or terminate accounts that violate this section.
10. AI Generated Content
Krixa AI uses third-party artificial intelligence providers to generate content based on your inputs. AI-generated outputs are produced automatically and may contain errors, inaccuracies, or content that does not match your intended purpose. You acknowledge that you must review all AI-generated content before publishing or distributing it. Krixa AI does not guarantee the accuracy, completeness, or suitability of any AI-generated output.
11. Content Ownership
You retain all ownership rights to the content you submit to Krixa AI ("Your Inputs") and to the outputs you generate using the service ("Your Outputs"). We do not claim ownership over Your Inputs or Your Outputs. You grant Krixa AI a limited, non-exclusive, royalty-free licence to use, process, and store Your Inputs solely for the purpose of providing and improving the service. We do not use your content to train foundation AI models.
12. Service Availability
We aim to provide reliable and continuous service, but we do not guarantee that the service will be available at all times or free from errors, interruptions, or delays. We may perform maintenance, updates, or modifications that may temporarily affect availability. We will endeavour to provide reasonable notice of scheduled maintenance where practicable.
13. No Guarantee of Results
Krixa AI provides tools to assist with content creation. We do not guarantee any specific marketing, business, or financial results from the use of our service. The effectiveness of content generated through Krixa AI depends on numerous factors outside our control, including market conditions, audience behaviour, and your own marketing strategy. Any reliance on the service is at your own risk.
14. Limitation of Liability
To the maximum extent permitted by applicable law, Krixa AI and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the service. Our aggregate liability for any claim arising out of these Terms shall be limited to the total amount paid by you for the service in the twelve (12) months preceding the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
15. Account Termination
You may terminate your account at any time by contacting us at hello@krixa.ai or through your account settings. We reserve the right to suspend or terminate your account immediately if you materially breach these Terms, engage in unlawful or abusive conduct, or if required by law. Upon termination, your right to access the service ceases immediately, and we may delete your account data after a reasonable retention period in accordance with our Privacy Policy.
16. Changes to Terms
We may update or modify these Terms from time to time. Material changes will be communicated to you via email or through an in-product notice at least 30 days before the changes take effect, where practicable. Your continued use of the service after the effective date of any updated Terms constitutes your acceptance of the revised Terms.
